1. General Information

These Terms of Service apply to purchases made through sanssucre studio, operated by David Kardel, Olivaer Straße 7, 22049 Hamburg, Germany. By placing an order through our website, you agree to these terms, subject to your mandatory rights under applicable consumer protection law.

2. Products

sanssucre studio offers independently designed, handmade ceramic objects. Due to the handmade nature of our products, minor variations in colour, glaze, surface and finish may occur. Such variations do not affect your statutory rights if a product is defective or does not conform to its description. Product images are intended to represent the objects as accurately as possible. Colours may appear differently depending on screen settings. Product availability is subject to stock levels displayed in our online store.

3. Orders and Contract Formation

Products displayed on our website do not constitute legally binding offers. By completing the checkout and submitting your order, you make a binding offer to purchase the selected products. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance. A purchase contract is concluded when we expressly accept your order, for example through a separate acceptance confirmation or dispatch confirmation. If we cannot accept your order, we will inform you and refund any payment already received without undue delay.

4. Prices and Payment

Prices are displayed in the currency selected for your shopping region. For customers in Germany, displayed prices include applicable German VAT. Prices and tax treatment for international orders may vary depending on the destination and applicable tax regulations. Shipping charges are displayed before the order is submitted. Available payment methods are shown at checkout. Payments are processed through the payment providers offered by our store.

5. Shipping and Delivery

Orders are shipped from Germany to the destinations available at checkout. Shipping costs, available delivery methods and estimated delivery times are provided during checkout and in our Shipping Policy. Delivery times are estimates and may be affected by customs processing or circumstances beyond our control. For international orders outside the European Union, import duties, taxes and customs clearance fees may apply. Unless expressly stated otherwise at checkout, these charges are payable by the recipient. Risk of accidental loss or damage passes to consumers in accordance with applicable statutory law.

6. Returns and Withdrawal

Consumers have a statutory right of withdrawal where applicable. For eligible consumer purchases, the statutory withdrawal period is generally 14 days from receipt of the goods. Statutory consumer rights remain unaffected.

7. Statutory Warranty Rights

Statutory rights concerning defective or non-conforming goods apply without restriction. Nothing in these Terms of Service excludes or limits mandatory consumer rights, including statutory warranty rights. The handmade character of a product does not exclude these rights.

8. Intellectual Property

Unless otherwise indicated, original product designs, photographs, videos, texts and visual materials presented on this website are the intellectual property of sanssucre studio or their respective rights holders. Commercial reproduction or use without the relevant rights holder's permission is prohibited, except where permitted by applicable law. Purchasing a physical product does not transfer intellectual property rights in its design or related creative materials.

9. Liability

We are liable without limitation in cases of intent, gross negligence, injury to life, body or health, and where liability is mandatory under applicable law. In cases of slight negligence, liability for breach of essential contractual obligations is limited to foreseeable damage typical for the contract, where legally permissible. Mandatory statutory liability, including liability under applicable product liability legislation, remains unaffected.

10. Privacy

Personal information is processed in accordance with our Privacy Policy, available on our website. Our online store is powered by Shopify, which provides the technical infrastructure for shopping and checkout. 11. Applicable Law

These Terms of Service are governed by German law. For consumers residing outside Germany, this choice of law does not deprive them of mandatory consumer protections applicable under relevant law. Mandatory rules regarding jurisdiction and consumer rights remain unaffected.

12. Changes to These Terms

We may update these Terms of Service when necessary. Changes do not retrospectively alter contracts already concluded unless legally permitted and agreed upon. The terms applicable to an order are those in effect when the contract is concluded.
